Terms of service
What we provide, and on what terms.
Kengele Technology is incorporated in the United Arab Emirates, in the Meydan Free Zone, Dubai, registered on 12 August 2026. A Kenyan operating company is being formed and these terms will be updated to name it when it is. In these terms, we and Kengele mean Kengele Technology, and you means the business using this website or our software.
What these terms cover
This website, and the Kengele software you use once you are a customer, including anything it connects to on your instruction.
They are not the whole agreement for paid work. What we build for you, what it costs and what we undertake to deliver is set out in a written agreement signed before work begins. Where that agreement and this page differ, that agreement wins.
This website
It introduces Kengele and lets you get in touch. Nothing on it is an offer capable of acceptance, and sending a form does not create an agreement or oblige either of us to anything. We may reply, or decline to work with you, without giving a reason.
We describe what Kengele does as honestly as we can, including what is not finished. Descriptions here are general; what we could do for your business is a matter for a conversation and then a written agreement, not for a web page.
What we provide
Kengele creates a cloud account on Amazon Web Services in your name, sets it up, installs the applications you have asked for, connects the tools you already use, and manages it: monitoring, backups, updates and support.
The account is yours, not ours. Your business records live inside it. We reach in through access roles granted within that account — you can see them, audit what they did, and remove them yourself at any time, without asking us. Removing our access will stop us supporting you, but it will not take anything away from you.
Connecting other software
You may ask us to connect services you already use, such as QuickBooks, so that information moves between them automatically.
When you do:
- You authorise it yourself, through that provider's own sign-in. We never ask for your password to another service.
- You can withdraw it at that provider, at any time, without telling us first.
- We ask for the narrowest access that does the job, and we will tell you what we are asking for and why.
- What is read goes into your own account, not into a system we own. We do not keep a separate copy and we do not use your information to train models or build anything for anyone else.
- You remain bound by that provider's own terms, and we are not responsible for their service, their availability or their charges.
Where a connection can write back into another system, we will tell you before it is enabled, and anything that changes your financial records is something you approve rather than something that happens quietly.
What we ask of you
Use the enquiry forms for genuine enquiries, and do not send documents, financial records, credentials or other people's personal information through them — they are not built to receive those.
Do not use our software unlawfully, do not attempt to reach parts of it that are not yours, and do not use it to store or process material you have no right to. Keep your own sign-in credentials to yourself, and tell us promptly if you think someone else has them.
Availability
We work to keep things running and we will tell you about planned work in advance. We do not promise uninterrupted service on this page; where a specific availability commitment applies to you, it is in your written agreement.
Parts of what we provide depend on other companies — Amazon Web Services, and whichever services you ask us to connect. When one of those is unavailable, the part depending on it will be too.
Ending it
Either of us may end the arrangement as set out in your written agreement. If it ends, your account and everything in it stays yours and we remove our access. There is nothing for you to migrate away from, because nothing of yours was ever somewhere else.
Our software
The software and designs Kengele builds remain ours, and you may use them for your business for as long as you are a customer. Your business records, and anything you create using the software, remain entirely yours.
What we are responsible for
We will provide our services with reasonable skill and care. We do not promise that software will be free of faults or that a service we depend on will always be available.
We are responsible for loss we cause by failing to meet that standard. We are not responsible for business losses — lost profit, lost revenue, lost business or lost opportunity — nor for loss of data you could have recovered from the backups we provide and you control. Where a limit on our liability applies, it is the amount you paid us in the twelve months before the matter arose.
Nothing here limits liability that cannot be limited by law, including for fraud.
Which law applies
These terms are governed by the law of the United Arab Emirates, and the courts of Dubai have jurisdiction. If you are a business in Kenya, this does not remove rights you have under Kenyan law that cannot be set aside by agreement, including under the Data Protection Act.
Where a signed agreement between us names a different law or forum, that agreement applies instead.

Changes
If we change these terms we will change the date below, and we will tell customers directly about a change that materially affects them.
